General Direction—third party arrangements for training and/or assessment of VET courses

An RTO must obtain prior approval in writing from ASQA to enter into an arrangement with a non-RTO (the third party) in relation to the ‘VET courses of concern’ … on behalf of the RTO:

• advertise or offer a VET course of concern
• deliver training and/or assessment in a VET course of concern
• issue a VET qualification or statement of attainment for a VET course of concern.

VET courses of concern:

• TAE40116 Certificate IV in Training and Assessment
• TAE50216 Diploma of Training Design and Development
• TAE50116 Diploma of Vocational Education and Training
• TAESS00013 Enterprise Trainer—Mentoring Skill Set
• TAESS00015 Enterprise Trainer and Assessor Skill Set
• TAESS00014 Enterprise Trainer—Presenting Skill Set
• TAESS00011 Assessor Skill Set.

I saw the new ASQA directive. Could you please inform me how the directive is to be interpreted?

Is specific prior ASQA permission required if units in those TAE skillsets are offered as electives in another qualification when they comply with the packaging rules of that qualification and delivered in a third party relationship?

Example 1

The XYZ RTO wishes to offer the CHC32015 - Certificate III in Community Services through a third party agreement with WXY Inc. The electives of the Certificate III will include the following units:

• BSBCMM401A Make a presentation
• TAEDEL301A Provide work skill instruction

Example 2

The KLM RTO wishes to offer the BSB42015 - Certificate IV in Leadership and Management through a third party agreement with RSTUV Inc. The electives of the Certificate IV will include the following units:

• TAEDEL301A Provide work skill instruction
• TAEDEL404A Mentor in the workplace

Thank you for your enquiry.

No, TAE units named in training products and delivered to achieve other outcomes are not considered a ‘VET courses of concern’ as listed in Schedule 1 of the General Direction - Third party arrangements for training and/or assessment of VET courses, and are not required to obtain approval in writing from ASQA to enter into an arrangement with a non-RTO (the third party) to deliver those training products.

Additionally, before offering them it is important to note the currency of training products. For example: BSBCMM401A was superseded by BSBCMM401 - Make a presentation 24/03/2015 as such – unless the unit BSBCMM401A is named within a qualification it should not have been offered or delivered (standalone or as an imported elective) after the completion of transition 23/03/2016. Likewise TAEDEL301A and TAEDEL404A are out of transition and cannot be offered under these circumstances either.
